On October 22, 2020, Rospatent issued a decision rejecting the third objection on the validity of patent RU 2240848. This patent owned by «Kalancha» LLC has already faced three objections in total filed by «Plamya» LLC and all the time was successfully defended by the patent team of «A.Zalesov & Partners» Patent & Law Firm. Let us remind you that first two objections attacked the patentability requirements: the first argued on lack of novelty and the second — on inventive step. The third objection was related to the sufficiency of disclosure requirement, according to which a patent application must disclose a claimed invention in sufficient detail for the person skilled in the art to carry out the claimed invention. Based on law in force on application date such requirement on sufficiency of disclosure was not set and hence objection has no legal basis.
