On May 11, 2023, the Russian IP Court considered the cassation complaints of OOO «ALVILS» and AO «Kirov Pharmaceutical Factory» against the decision of the Moscow Arbitration Court dated August 26, 2022, regarding case No. A40-20467/2022 and the decision of the Ninth Arbitration Court of Appeal dated November 22, 2022, in the same case.
The interests of «ALVILS» in this dispute were represented by the team of «A.Zalesov & Partners» Patent & Law Firm under the leadership of the Managing Partner Aleksey Zalesov.
In February 2022, the patent owner filed a lawsuit to protect RU patent on invention No. 2293744 claiming that the defendants manufacture, offer for sale and put into civil circulation in the territory of the Russian Federation a medicinal product that uses the invention under the Plaintiff's patent.
The Moscow Arbitration Court as well as the Ninth Arbitration Court of Appeal satisfied the claims, prohibited manufacturing, offering for sale and putting into civil circulation in the territory of the Russian Federation of our client's medicinal product until the Plaintiff's patent expires.
The IP Court, as a court of cassation, canceled the decision of the Moscow Arbitration Court and the decision of the Ninth Arbitration Court of Appeal and the case was sent for a new consideration to the Moscow Arbitration Court.
