On August 24, 2023, «A.Zalesov & Partners» Patent & Law Firm celebrates its sixth anniversary.

In view of massive and not always precise information about amendments into IP enforcement practice in Russia our team has prepared a brief digest of the anti-sanction measures and latest amendments introduced into the Russian legislation.

Federal Law No. 143-FZ dated May 28, 2022 «On  Amendments to Part Four of the Civil Code of the Russian Federation» introduced amendments specifying the grounds of refusal for trademarks that include names of geographical objects. The purpose of the amendments is to harmonize national legislation with Article 11 of the Geneva Act of the Lisbon Agreement on Appellations of Origin and Geographical Indications.

On February 08, 2022, the affiliate session of «A.Zalesov & Partners» Patent & Law Firm - «Patent disputes in pharma: the letter of the law vs extreme necessity»  - took place in the framework of the Distant & Digital conference.

Extension of the Eurasian patent became available for patentees for not so long but already created some legal challenges for patent lawyers. For example, the problem of the impossibility of challenging the legality of the extension of Eurasian patents in national courts has recently become particularly acute and attracted the attention of experts.

The Russian IP Court calls for Scientific Council to work out positions on trademark protection of a product shape

The need to grant legal protection to 3D trademarks is indisputable, while in practice trademark applicants in Russia face a restrictive interpretation of the current rules of law by Rospatent, especially if the claimed designation is the shape of a product or its packaging.

Russian IP professionals involved in patent litigation in the pharma field have been intensively discussing a new Ruling of the Presidium of the Intellectual Property Court, which gave new guidelines in the ways of challenging a Supplementary Protection Certificate (SPC), granted with a breach of law. But still, although the Ruling contains crucial conclusions regarding the nature of SPC, it is not clear whether the Court has resolved the topical question of the case.
