«Soremartec» S.A. (a part of «Ferrero Group»), a client of «A.Zalesov & Partners» Patent & Law Firm filed a trademark infringement action with the Arbitration Court of the Dagestan Republic against a local supplier of confectionaries. The plaintiff claimed final injunction and monetary compensation.

The plaintiff found out that some local stores were selling counterfeits to consumers. Initially, before filing the lawsuit the plaintiff applied for preliminary injunction measures asking the court to prohibit the local stores  from trading the counterfeits. The Arbitration Court of the Dagestan Republic satisfied the relevant petition and imposed the preliminary injunction which is quite a rare case in trademark infringement disputes not referred to domain and online disputes. At the same time the stores provided evidence confirming their receipt of the disputed counterfeits from the supplier. The stores immediately removed the counterfeits from sale and destroyed them. Taking into account the cooperation of the stores the Plaintiff decided to sue the supplier only.

On March 25, 2021, the Arbitration Court of the Dagestan Republic proclaimed a resolutive part of the judgment satisfying the lawsuit in full.
