On December 17, 2020, the Federal Antimonopoly Service of the Moscow region held a hearing on two unfair competition disputes between «DIAMED-Pharma» LLC, the patent holder, «Trokas-Pharma» LLC (the first case) and «Groteks» LLC (the second case). The act of unfair competition consisted in the introduction of a drug into the market by competitors in which a patented invention for an arthrological drug was used.
The defendants argued that there had been no violation of the patent, since there had been no use of all the features of an independent claim, and at the same time they also referred to prior use, which according to the specialists of «A.Zalesov & Partners» Patent & Law Firm were absolutely contradictory arguments.
The Federal Antimonopoly Service of the Moscow region supported the position of «DIAMED-Pharma» LLC and issued an order to bot «Trokas-Pharma» LLC and «Groteks» LLC.
