On October 15, 2019 the Intellectual Property Court satisfied in full claim filed by the attorneys of «A.Zalesov & Partners» Patent & Law Firm against the Russian Patent and Trademark Office (Rospatent), which previously rejected the application of «Soremartec» S.A. («Ferrero» Group) to recognize the trademark «Raffaello» as well known. Confectionary «Raffaello» offered by «Ferrero» Group is very popular in Russia, while the awareness that the trademark owner is «Soremartec» S.A. is quite limited. Attorneys of «A.Zalesov & Partners» Patent & Law Firm successfully argued the position of the legal mistake made by Rospatent, and convinced the Intellectual Property Court that the well known status should have been recognized due to the wide notoriety and fame of the trademark «Raffaello» for the confectionary goods proceeding from a single source — «Ferrero» Group — without references to the notoriety of the exact trademark holder — company «Soremartec» S.A. of said group. «Soremartec» S.A. was represented before the court by Aleksey Zalesov, Managing Partner of «A.Zalesov & Partners» Patent & Law Firm, and Vladislav Ryabov, Senior Associate.
