Acting on behalf of the client, «Soremartec» S.A. (part of «Ferrero Group»), the associates of «A.Zalesov & Partners» Patent & Law Firm filed a statement with the police of Krasnodar against the local seller of confectionaries imitating «RAFFAELLO» candies.
The police conducted an inspection, seized the disputed goods and filed a statement of claim with the Arbitration Court of Krasnodar region asking the court to bring the seller to administrative liability in accordance with article 14.10 of the Russian Code of Administrative Offenses (the illegal use of the means of individualization of the products).
Our associates prepared and filed a motion on behalf of the client to enter the case as a third party along with the written submissions upholding the police's statement. The court satisfied the motion and let our client participate in the case and provide additional arguments proving counterfeit.
On June 03, 2021, the Arbitration Court of Krasnodar region ruled to bring the defendant to administrative liability under article 14.10 of the Russian Code of Administrative Offenses and imposed a fine in the amount of more than 1,100 EUR.
