On September 28, 2021, after almost one-year consideration of a trademark infringement dispute, the Arbitration Court of St. Petersburg and Leningrad Region satisfied the claims of «Soremartec» S.A. («Ferrero» Group) seeking for prohibition of illegal use of Raffaello trademarks and claiming for monetary compensation for the past infringement.
The evidence of trademark infringement were solid, and during consideration of the case new documents were provided by defendants about the source of the counterfeit product in question, allowing to involve their respective suppliers as co-defendants into the case. Finally, by the end of September, the claims were filed against 6 defendants, and monetary compensation was demanded from two of them. The judge ruled to satisfy the injunction claims against all 6 defendants as well as claims to destroy the infringing products, and ruled that the first supplier in the chain should pay compensation in amount of approximately 11,500 EUR.
