A foreign company filed a claim with the court regarding the infringement of the Russian patent No. 2656310 in the production and sale of a herbicide by the client of «A.Zalesov & Partners» Patent & Law Firm - «AGRO EXPERT GROUP» LLC.
«A.Zalesov & Partners» team, while representing the interests of the client, filed an objection to Rospatent against the grant of Russian patent No. 2656310 for the invention «Herbicide composition».
During the consideration of the objection, Rospatent came to the conclusion that the invention under the patent does not meet the term of patentability.
The patent holder exercised the right to amend the claims of the invention, reducing the scope of protection. However, based on the results of an additional search, the examination concluded that the invention according to the amended claims also did not meet the terms of patentability.
Despite the patent holder's objections, on December 19, 2024, the Board of the Chamber for Patent Disputes ruled to satisfy our objection and considered Russian patent No. 2656310 invalid in full.
