Our client, «SOREMARTEC» S.A., has filed a statement with the police against a local seller of confectionaries imitating «RAFFAELLO» candies. The police seized the disputed goods and filed a statement of claim with the Moscow Arbitration Court asking the court to bring the seller to administrative liability under article 14.10 of the Russian Code of Administrative Offenses (the illegal use of the means of individualization of the products).
Our associates have prepared and filed a motion on behalf of the client to enter the case as a third party and written submissions upholding the police's statement. The court has satisfied the motion and let «SOREMARTEC» S.A. participate in the case and provide additional arguments proving counterfeit.
On April 28, 2021, the Moscow Arbitration Court brought the defendant to administrative liability in accordance with article 14.10 of the Russian Code of Administrative Offenses and imposed a fine in the amount of more than 1,100 EUR.
