«Intellectual Property Right» magazine No. 4'2021 published an article by the Managing Partner of «A.Zalesov & Partners» Aleksey Zalesov entitled «The establishment of a patent right as a monopoly right of the patent holder (the historical aspect)» (in Russian).
The author analyzes the historical development of the patent systems of England, the USA, France, Germany and Russia and the establishment of patent right as an institution of rights protection of a patent holder rather than an inventor. He also points out the systematical nature of the abuse of patent monopoly, which contradicts to the interests of sustainable economic development in compliance with the legitimate interests of society.
