On May 06, 2022, the Ministry of Justice of the Russian Federation registered the Order of the Ministry of Industry and Trade of Russia On approval of the list of goods (groups of goods) in respect of which the requirements for the protection of intellectual rights by the right holders (patent holders) of products that were put into circulation outside the territory of the Russian Federation are not applied.
The parallel importation mechanism, which involves the legalization of the import of goods into the country without the permission of the right holder, became effective on May 06, 2022. The list of goods for parallel importation includes more than 50 groups of goods:
- certain types of goods without exceptions for any brands,
- certain types of goods with exception of some brands, for which parallel importation is not allowed;
- certain types of goods with limited list of brands, for which parallel importation is allowed.
From now on, customs authorities must verify the Foreign Economic Activity Commodity Nomenclature (FEACN) codes and brand names with the order of the Ministry of Industry and Trade.
