The Presidium of the IP Court has ruled on important practical issue regarding trademark use on goods it has been registered for, and the scope of its actual use in case of a non-use cancellation action. The IP Court followed the same approach, and once again commented, that in case a trademark is used for a narrower item, such a use is also considered due use for the whole class of goods. Such approach helped to safeguard the trademark «Zazhivin» used for gel-balsams with respect to a broad goods item in Class 03 of the Nice Classification: «skin care products cosmetics; cosmetic products».
