TheIPhEB International Pharmaceutical and Biotechnology Business Forum was held in St. Petersburg from April 7 to 9. On April 9, the event was attended by Julia Dutikova, Candidate of Biological Sciences (Oncology), Patent Attorney of the Russian Federation, Eurasian Patent Attorney, head of the Group for patenting in the area of medicine and pharmaceuticals at «A.Zalesov & Partners». At the "Dialogues on Clinical Research" Conference Julia made a presentation on "Clinical research data in assessing the patentability of pharmaceutical inventions", in which she touched on the following topics:

  • Different approaches to the use of information on clinical trials of medicines from open databases (Clinical.Trials.gov, EU CTIS) to assess the patentability of medical and pharmaceutical inventions;
  • Contradictions between the mandatory early publication of data on the progress of drug research and the requirement of worldwide novelty of the invention;
  • Criteria for qualifying clinical trial data as prior art, based on the analysis of foreign and domestic judicial practice;
  • Practical recommendations on the strategy of patenting objects related to drug treatment methods and applications of these drugs in conditions of simultaneous clinical trials.
