One of the «A.Zalesov & Partners» client's competitors filed an objection to the grant of a client's patent for a composition for regulating sexual activity in small domestic animals. Rospatent upheld the objection and declared the patent invalid in its entirety.
Disagreeing with this decision, «A.Zalesov & Partners» team, representing the interests of the client, appealed to The IP Court to invalidate Rospatent's decision.
We have developed and implemented a comprehensive strategy to protect the client's interests and were able to prove the illegality of Rospatent's conclusions. «A.Zalesov & Partners» specialists pointed out that Rospatent unreasonably opposed sources from the prior art, since they cannot be used to confirm the well-known features of the composition for regulating sexual hunting as they lacked the relevant information. During the dispute, the Court retained an expert who supported this position.
The IP Court took into account our arguments and evidence, and as a result of its consideration on March 30, 2026, issued a decision satisfying our client's claims and invalidating Rospatent's decision.
