On October 26, 2026, the Arbitration Court of the Moscow Region fully satisfied the claims of the Russian pharmaceutical company NVP ASTRAPHARM LLC for the granting of a compulsory license for inventions protecting the substance with the INN Fluralaner and pharmaceutical compositions containing this compound, for further production and introduction of its own medicinal product for veterinary use.

The defendants (foreign companies Nissan Chemical Corporation and Intervet International BV) marketed the veterinary drugs «Bravecto» and «Bravecto Spot-on», which contained a substance with the INN «Fluralaner», until 2022. «Bravecto» is a systemic insecticidal acaricidal agent intended for the prevention and treatment of external parasites in dogs and cats. The advantages of this drug were its effectiveness, rapid onset, and long duration of action.

However, from 2022 to 2026, this drug officially ceased to be imported into the territory of the Russian Federation at the initiative of the manufacturer, which led to its shortage on the Russian market.

«A.Zalesov & Partners» attorneys successfully secured a compulsory license for inventions necessary for the client's production and commercialization of its own medicinal product. This case was complicated by the fact that in the spring of 2026, the defendants officially imported a batch of the disputed medicine into the Russian market, and this drug  was also subsequently manufactured and commercialized by another Russian pharmaceutical company, which also received court approval to use the inventions, supporting the defendants' arguments that there is currently no shortage of the drug. Despite this, «A.Zalesov & Partners» team was able to prove the defendants' insufficient use of their inventions and the resulting shortage of an important veterinary drug on the market.

The client's interests in this case were represented by Aleksey Zalesov, Head of Intellectual Property Practice, Julia Dutikova, Head of the Group for patenting in the area of medicine and pharmaceuticals, and Julia Kolomytseva, senior associate.
