On September 1, 2025, amendments to Article 16 of the Law of the Russian Federation Consumer Protection Law (Federal Law No. 69 of April 7, 2025) came into force, introducing an explicit ban on the imposition of additional goods and services.

The essentials of the amendments is that any additional services or products require explicit consent from the consumer. The “default consent” is prohibited.

What exactly is prohibited:

  • Automatically adding paid delivery or services to the online order cart

  • Conditional discounts ("get item for 250 rubles only when purchasing an additional item")

  • Selling the medicine with related products only

What is allowed:

  • Recommendations from a pharmacist (for example, a probiotic with an antibiotic), provided that refusal to purchase the additional product does not affect the ability to purchase the medicine

Penalties:

  • Fines of up to 500,000 rubles for organizations. Consumers have the right to demand a refund, compensation for moral damages and a fine of 50% of the amount.

Sergey Zagraevsky , an advisor in ZTG's Antitrust and Public Procurement Practice , warns of the risks of unfair consumer claims and competitors' provocations. Pharmacies are advised to review their upselling procedures and document flow to minimize legal risks.
