Deputy Chairman of the Supreme Court of the Russian Federation denied the Swedish company AstraZeneca AB's request to refer its complaint in case No. SIP-298/2025 for consideration by the Judicial Collegium for Economic Disputes of the Supreme Court of the Russian Federation.

Thus, the Supreme Court of the Russian Federation has definitively upheld the legality and validity of the decision and ruling of the Intellectual Property Court in case No. SIP-298/2025, in which «A.Zalesov and Partners» defended the right of AKRIKHIN JSC to use its inventions with the compound Dapagliflozin and a pharmaceutical composition containing Dapagliflozin in the medicinal product Fordiglyf, which is used to treat type 2 diabetes.

«A.Zalesov and Partners» attorneys also secured an injunction against AstraZeneca AB and AstraZeneca Pharmaceuticals LLC preventing the client from marketing the medicinal product Fordiglyph.

The entire professional community eagerly awaited the outcome of this case, emphasizing the importance of good faith behavior and aiming to protect the public interest by preventing the removal of an invention from the public domain after the termination of exclusive rights, regardless of the grounds for such termination.

This decision is also significant for the Russian pharmaceutical market, setting guidelines for the correct balance of interests of IP right holders and manufacturers exercising their legal right to produce medicine based on publicly available data and technologies.

Furthermore, the court rulings in the case won by «A.Zalesov and Partners» accelerated the market entry of generic drugs bearing the INN Dapagliflozin, significantly lowering the cost of therapy and reducing budget expenditures on public procurement.
