On behalf of the client, «Zetta Insurance» Company, «A.Zalesov & Partners» Patent & Law firm filed an application for the combined trademark «ROSNO Russian Insurance Public Company». Upon the examination, Rospatent issued a preliminary refusal to register the trademark, stating that the word elements «Russian Insurance Public Company» are non-protectable and that the trademark could be registered with the exclusion of these word elements from legal protection. The client disagreed with the examiner and wanted to maintain the trademark's full protection.
Although Rospatent rarely sides with the applicant and upholds protection in cases where elements border on descriptiveness, the patent attorneys of «A.Zalesov & Partners» Trademark Division successfully presented arguments that convinced the examiner to register the trademark without disclaiming the word elements «Russian Insurance Public Company».
