«Canon Kabushiki Kaisha», a client of «A.Zalesov & Partners» Patent & Law Firm, faced the infringement of the rights by the Russian legal entities who introduced the product to the market with the use of patents №2657119 and №2568045 belonging to our client. This project is one of a series of patent infringement lawsuits in which we have successfully represented our client as a plaintiff. One of the defendants in that particular dispute is a big supplier of printer components to the Russian market.
The case is noteworthy, in particular, since the judicial request was forwarded to the Federals Customs Service for providing information about the parties who had imported the disputed goods as well as the copies of declarations specified in the settlement documents and certifying the purchase of the cartridges from one of the defendants. As a result, the importers of the goods were involved as third parties.
On July 15, 2021, after almost two years' dispute, the Moscow Arbitration Court partially satisfied the claims of «Canon», having ruled to recover monetary compensation in the amount of 29,000 EUR approx.
The court of the first instance has rejected the client's non-monetary claims to prohibit the sale in the future citing the impossibility of satisfying them. Such consideration of non-monetary claims causes disputes among the specialists and requires interpretation by courts of subsequent instances.
