A third party filed an objection to the issuance of a patent belonging to the client of «A.Zalesov & Partners» - a Russian company developing, manufacturing, and marketing highly effective veterinary medications for specific problems affecting domestic animals - for a composition for regulating estrus of small domestic animals. Rospatent upheld the objection and invalidated the patent in full.
Disagreeing with this decision, «A.Zalesov & Partners» team filed an appeal with the IP Court to invalidate Rospatent's decision, representing the interests of the patent holder (Case SIP-153/2024).
During the process, «A.Zalesov & Partners» team developed and implemented a comprehensive strategy to protect the client's interests, which also included Case SIP-237/2024, which sought to invalidate and render inapplicable certain provisions of the Rules for the preparation, submission and review of documents forming the basis for legally significant actions related to state registration of inventions. Although the courts found the provisions of the Rules to be in accordance with the law, the court rulings provided important clarifications regarding the application of these provisions, which were directly relevant to the patent validity dispute.
The Russian IP Court considered our arguments and evidence in the case and on September 11, 2025, issued a ruling upholding our client's claims and invalidating Rospatent's decision to uphold the patent objection as inconsistent with paragraphs 1 and 2 of Article 1350 of the Civil Code of the Russian Federation.
Thus, the team of «A.Zalesov & Partners» Patent & Law Firm succeeded in overturning the administrative body's unlawful decision.
