The «Law and Economics» magazine published an article by the Managing Partner of «A.Zalesov & Partners» Aleksey Zalesov entitled «On the economic inexpediency and inapplicability of criminal liability for infringement of invention and patent rights» (in Russian).
The author of the article substantiates why Article 147 of the Criminal Code of the Russian Federation, which establishes the liability for infringement of property patent rights, as well as a number of non-property rights and freedoms of the inventor and applicant under a patent application, is practically inapplicable and economically inefficient in relation to some of the elements described in it.
