On the amendments to part four of the Civil Code of the Russian Federation

Federal Law No. 386-FZ of October 07, 2022 brought the amendments into Article 1363 of Part Four of the Civil Code of the Russian Federation.

In accordance with the amendments, starting from October 18, 2022, challenging the extension of the validity term of the invention (challenging an additional patent for an invention) will be carried out by filing claims with Rospatent. Previously, due to the absence of a direct norm of the law on the administrative procedure for the protection of civil rights, a judicial procedure was applied for their protection by filing a claim with the Russian IP Court.
