According to the amendments presented in the Resolution, the 30% discount for filing applications to the Federal Service for Intellectual Property (Rospatent) in electronic form is abolished.
In addition, official fees are increasing (by 10-15%) for the performance of legally significant actions related to intellectual property objects.
For example*:
- Official fee for registering an application for a patent for an invention will be 4,000 rubles (previously 3,300 rubles);
- Carrying out an expert examination of a designation applied for as a trade mark and taking a decision based on its results will cost 13,000 rubles (previously 11,500 rubles);
- Consideration of oppositions filed with the Federal Service for Intellectual Property and taking a decision on the results of consideration thereof against granting legal protection to a trademark commonly known in the Russian Federation will cost 30,000 rubles (previously 25,000 rubles).
The changes also significantly affected the procedure for paying fees for maintaining patents for inventions, utility models and industrial designs in force. Fees will be paid simultaneously for five-year periods of validity: from the 6th to the 10th year of validity, from the 11th to the 15th, from the 16th to the 20th, from the 21st to the 25th. At the same time, if at the time of payment of the fee for maintenance the fee has been paid partially for an incomplete five-year period, the fee will be payable in the amount established for the current period, minus the amount of previously paid fees.
